This website was established to provide information regarding a class action lawsuit regarding the JK Harris Settlement.

Class Members include all persons who contacted JK Harris for tax resolution services that included the preparation and negotiation of an Offer in Compromise prior to March 31, 2005.

All deadlines to file claim forms or requests to be excluded from the Class have expired.

The Court approved the Settlement and the first installment of pro-rated payments to qualified Class Members mailed February 13, 2009. Payments are based on the amounts paid to JK Harris on contracts for tax resolution services, which included the preparation and/or negotiation of an Offer of Compromise (some contracts did not include the negotiation service).

The second installment of pro-rated payments will be mailed April 16, 2010.

In accordance with the terms of the Settlement, payments are made from the remaining Settlement Fund after deductions of all items including the cost of Claims Administration, Attorney Fees, and service awards to the Class Representatives.

As part of the Settlement, JK Harris was scheduled to make monthly payments to the settlement fund for subsequent pro-rata payments to Class Members in 2010, 2011, and a final installment in 2012. In May 2009 JK Harris ceased making payments to the Settlement Fund due to its financial condition.

Class Counsel filed a Motion to Enforce the Court Approved Settlement, for Contempt of Court, for Sanctions, and for Costs. Hearings regarding the motion took place February 17, 2010 and February 25, 2010. At the February 25, 2010 hearing, the parties announced modifications to the terms of the settlement which will be submitted for final Court Approval on June 4, 2010.
